订约双方并同意由甲方或其法定代表在领取各项付款时，为证明有权领用上述各次付款（第一次付款除外，因其另有保证），必须由建筑师作出评定，证明已经收到的付款之价值已经消耗在劳务及材料费用之中。

上述协议如未能忠实执行，则违约一方同意其应享有权利自动丧失，且在违约之日后一个月之内，向对方或其法定代表赔偿人民币_____元整，作为商定之损失赔偿费。
